Why would you need to modify a custody order?

A court order must be followed after a divorce. For instance, the judge may issue a child custody order. This splits up physical custody time and may also address legal custody rights. You have to follow this order as long as it is on file.

That said, it is possible to modify a child custody order. By taking the proper steps, you can get the court to make the modification, although you should never change how you follow the order until this modification has been officially authorized.

Approving a relocation

One reason why you may need to modify a custody order is if you want to relocate and you need approval to do so because it would change how you address child custody. If you are moving to another state or another country, for example, it could significantly change how you split custody with your ex. The court needs to review the situation and may want to know why you are moving, such as to live closer to extended family members, to go to college or to take a job offer.

You also have to consider the child’s needs and how their situation may change. Say that your child develops a health condition that means they need a greater level of care. Does that change how you and your spouse split up custody time? Or say that they get into a private school, which is very prestigious, but which will change their general school schedule. Does that alter when you make exchanges or where the child lives during the school week?
