On Behalf of | Mar 18, 2024 | FAMILY LAW - Domestic Violence

Domestic violence doesn’t just refer to physical attacks. It may involve sexual or verbal abuse, which can also include manipulation or emotional damage. It’s a jarring ordeal that affects all types of families, such as couples expecting a child, housemates and former partners.

The National Coalition Against Domestic Violence reported about the state of domestic violence in New Jersey, accounting for 20% of violent crimes in 2018. In some scenarios, filing for a temporary restraining order (TRO) could be necessary to address domestic violence urgently.

Offenses with physical contact

Brutal acts of domestic violence include homicide, sexual assault, kidnapping, assault and rape. Other offenses are criminal restraint, lewdness, physical harassment and false imprisonment. New Jersey law also counts all other crimes that involve risks of severe injury or death.

Verbal threats and abuse

Despite the absence of physical contact, verbal abuse also has mortifying effects. Terroristic threats, stalking and verbal harassment can be grounds for domestic violence. Online harassment is another form of abuse that uses words, photos or videos to cause harm and humiliation.

Other criminal acts

Additional crimes that may fall under domestic violence include robbery, burglary, trespassing, mischief and coercion. Violating a TRO or final restraining order can also lead to a criminal charge.

The latest addition to New Jersey’s list of domestic violence acts is coercive control. In 2024, the state included acts that invade personal liberty. Examples are isolating the victim from loved ones and controlling their finances.

Putting an end to domestic violence

The horrors of domestic violence may put victims to shame and keep them silent. Taking legal action against it could be a tough battle. But the outcome after gathering the courage to leave an abusive situation can be liberating.
